COMMITTEE TO RECALL CAROLLO FILES A WRIT OF MANDAMUS TO CHALLENGE THE DECISION BY THE CITY CLERK NOT TO FORWARD THE 1914 PETITIONS TO THE COUNTY BOARD OF ELECTIONS FOR CERTIFICATION

I am withholding my RANT until this case is settled, because no matter how it is settled, this fight over timing is both a tremendous distraction and an unnecessary use of time, resources and energy in an effort that depends largely on momentum to succeed.

Having said that, there are now two issues related to the petitions.

The first is the obvious one tied to the submission of the petitions to the County Board of Elections which will be resolved in the courts, as evidenced by the complaint above.

The second issue surrounds news that was broken by Elaine Del Valle on her blog Political Cortadito last night, that after the receipt of these petitions by the City Clerk on Monday morning, they were scanned and converted to OCR - Optical Character Recognition - files.

Upon reading that, I submitted a public record request to the City Attorney for a digital copy of those files, and she responded that the City Clerk is the one who had done that.

I wrote Todd Hannon about this early this morning and want to give him an opportunity to respond to my questions before I say anything more about this, but the fact that these petitions were scanned into OCR files is disturbing, and raises very troubling questions.

Hopefully, one way or another we'll sort this out by this afternoon.
